• If the child has a physical, psychological, or emotional condition requiring an additional period of parental care, the associate is entitled up to an additional five (5) consecutive weeks of unpaid leave, beginning immediately after the end of the leave. • A request for leave must: − Be given in writing to the employer. − If the request is for leave under the Employment Standards Act, the request must be given to the employer in BC four (4) weeks before the employee proposes to begin leave, and in Ontario two (2) weeks before the employee proposed to begin leave. Stormtech recommends providing as much notice as is possible to plan for business coverage. − Be accompanied by a medical practitioner's certificate or other evidence of the associate’s entitlement to leave. • An associate’s combined entitlement to leave under the Employment Standards Act is limited to 78 weeks plus any additional leave the employee is entitled to in BC and up to 78 weeks in ON. • Associates continue to accrue vacation time while on Maternity/Parental leave however, if taken, the vacation time is without pay. Employment Insurance benefits could not be collected during this unpaid leave. The associate may use unpaid accrued time, according to BC and ON legislation, upon returning to work at a time convenient to the Company and Associate. • Associates who go on any leave are required to forward post-dated cheques to cover the employee paid Long Term Disability Premiums for the duration of their leave. RESPONSIBILITIES Managers are responsible for • Ensuring that associates are aware of their rights and obligations related to the leave. • Supporting and ensuring that associates have completed the necessary documentation to ensure a smooth transition to leave, including the transition of responsibilities prior to and returning from leave. • Establishing communication with the returning associate at least four (4) weeks prior to the return date. Associates are responsible for • Completing the Leave Request Form for eligible leaves within the timeframe and providing all necessary documentation. • Supporting the transition of work responsibilities prior to departure and communicating with their manager at least four (4) weeks prior to their return date. • Submitting the Return-to-Work Notification Form prior to returning to work, within the timeframe (4 weeks’ notice in BC or 2 weeks’ notice in ON) and communicating with their manager about their return. • If associates plan to change their return date in ON, returning earlier or later than originally noted, they must provide four (4) weeks’ notice.
