• The above entitlements will be pro-rated for partial years of employment. Associates will be given credit for the entire month of hire, regardless of the commencement date. • Part-time associates will receive vacation pay as a percentage of their earnings on each semi-monthly pay. Part time associates are eligible to take unpaid vacation leave based on the monthly accrual rate noted above (for example: 12 days per year upon hire); this is accrued on a pro-rata basis. • Contract associates will receive their vacation pay on each semi-monthly pay at the rate of 4% of gross earnings, in accordance with provincial legislation in each respective province. • Associates hired in the fourth quarter will not have completed three months of employment and are ineligible to take vacation leave until the following year. This carry over vacation leave must be used by the end of the following year. • Vacation pay does not accrue while an associate is on sick leave, long-term disability or other temporary or extended leaves of absence including temporary unpaid leave, maternity and/or parental leave. During these leaves and any protected leaves, associates will continue to accrue vacation time. The associate may use unpaid accrued time, according to BC and ON legislation, upon returning to work at a time convenient to the Company and Associate. 5. PROCESS • Associates must submit their full calendar year of vacation via Dayforce no later than February 15 or within 30 days from their start date of employment. • The submission of vacation by the associate does not need to include the carry over allocation of five (5) days. For example, if an employee has 15 days of vacation, they must book 10 days by the applicable and relevant date or timeframe and they have the ability to carry over five (5) days to the following calendar year • Vacation scheduling is the responsibility of department managers or supervisors who will ensure that all associates are given their full vacation entitlement while taking into account the efficiency of the department and operations. If a mutually acceptable time for the associate's vacation cannot be found or an associate chooses not to schedule his/her vacation, the company will exercise its right to decide on the scheduled vacation time. However, in this particular situation the associate will be provided at least two weeks’ notice in writing of the start date of their vacation. The associate must take their vacation at that time. • The most critical time of the year for our business is October 1 st to December 24 th . During this time frame, vacation requests are to be limited and will be granted at the sole discretion of each Manager. • Once the annual vacation allocation has been submitted by an associate, the dates may be flexible dependent upon availability of reallocation. • An associate who is unable to take his/her scheduled vacation entitlement at the scheduled time due to illness or an accident (which requires medical attention or hospitalization) occurring before the beginning of his/her vacation period may defer the vacation to a date agreed upon with his/her Manager. If an illness occurs during the authorized vacation leave, employees are not eligible to apply paid sick days unless special circumstances prevailed (i.e., an accident which required hospital stay).
