If a mutually acceptable time for the associate's vacation cannot be found or an associate chooses not to schedule his/her vacation, the company will exercise its right to decide on the scheduled vacation time. However, in this particular situation the associate will be provided at least two weeks’ notice in writing of the start date of their vacation. The associate must take their vacation at that time. • The most critical time of the year for our business is October 1 st to December 24 th . During this time frame, vacation requests are to be limited and will be granted at the sole discretion of each Manager. • An associate who is unable to take his/her scheduled vacation entitlement at the scheduled time due to illness or an accident (which requires medical attention or hospitalization) occurring before the beginning of his/her vacation period may defer the vacation to a date agreed upon with his/her Manager. If an illness occurs during the authorized vacation leave, employees are not eligible to apply paid sick days unless special circumstances prevailed (i.e., an accident which required hospital stay). • People & Culture and Payroll is responsible for monitoring vacation schedules and shall ensure vacation pay is paid correctly and in a timely manner, consistent with the provisions of this Policy. • Stormtech USA Inc. reserves the right to impose a mandatory vacation leave based on operational needs at its sole discretion. • Prior to an Associates last pay with the Company, People & Culture and Payroll calculate vacation entitlements that either need to be paid or deducted from the Associate on the last pay. VACATION PAY If an associate takes vacation leave and receives vacation pay prior to accrual and the associate leaves the company for any reason before such accrual is earned, Stormtech will deduct the vacation overpayment from any and all monies paid to the associate on their final pay until the overpayment has been reimbursed to the company. No payment will be made in lieu of vacation leave except where an associate ceases employment. 5. RESPONSIBILITIES Managers are responsible for • Receiving, reviewing, scheduling and approving vacation requests, providing documented confirmation of approval or denial and monitoring vacation time requested and taken. • Advising People & Culture/Payroll of any changes or revisions to approved vacation plans. Associates are responsible for • Adhering to the processes set forth in this policy and reporting any vacation or payment errors. People & Culture is responsible for • Monitoring vacation schedules and ensuring vacation pay is paid correctly and in a timely manner, consistent with the provisions of this policy.
