MILITARY LEAVE
1. PURPOSE Stormtech provides associates with military leave as defined by this policy. 2. SCOPE This policy applies to all Stormtech associates working in the State of California, who are members of the organized reserve of the United States Armed Forces, including the National Guard of the State. 3. POLICY • Associates called into active military service or enlisted in the uniformed services are eligible to receive unpaid military leave of absence. • Associates who are in the Guard, Reserves, or Naval Militia are entitled to up to 17 days of unpaid leave per year for military training, drills, encampment, naval cruises, special exercises, or similar activities in connection with the reserve training and instruction requirements of the armed forces of the United States, including the National Guard of this state. • Associates on military leave are entitled to the accrual of seniority, vacation and other rights and benefits that would have been earned if they had not been on military duty. • This leave shall be in addition to any annual vacation leave with pay to which the associate may be entitled. • To apply, the following conditions must be met: o The employee must provide prior notice of their military service to the employer,
o The total time spent in active military service must remain under 5 years, o The military discharge cannot be dishonorable or disqualifying, and o The return to work must be timely.
• Employees returning from leave under this policy will not be terminated without cause within one (1) year following the date of reemployment.
